Terms of service

Terms of Service

Welcome to Pearl City Antiques. We appreciate your interest in our carefully curated collection of antique and vintage furniture, decorative objects, and furnishings.

We believe purchasing antiques should be an enjoyable and informed experience. These Terms of Service explain the conditions governing use of our website and purchases made directly from Pearl City Antiques.

By using pearlcityantiques.com or placing an order with us, you agree to the applicable terms outlined below. Please review them carefully and contact us with any questions before purchasing.

1. About Pearl City Antiques

Pearl City Antiques is an independently operated antiques and vintage furnishings business based in Westfield, Massachusetts.

We specialize in antique American and English furniture, along with selected vintage and decorative items. Our inventory is sourced through estate sales, auctions, private collections, and consignments.

Our website is powered by Shopify, which provides the ecommerce infrastructure used to present products and process online transactions.

These Terms apply to purchases made directly through our website and, when provided in connection with a transaction, to purchases arranged directly with us through invoices or other agreed payment methods.

Purchases through third-party marketplaces may also be subject to the terms of those platforms.

2. Antique & Vintage Merchandise

The majority of items offered by Pearl City Antiques are antique, vintage, or previously owned.

Unlike newly manufactured merchandise, these pieces may display characteristics associated with their age, history, construction, and previous use.

Such characteristics may include surface wear, patina, minor irregularities, age-related shrinkage, old repairs, restoration, or replaced components.

We make every reasonable effort to identify and disclose significant condition issues and alterations that come to our attention.

Normal signs of age and wear, when accurately described and consistent with the nature of the item, should be expected when purchasing antique or vintage merchandise.

We encourage customers to review photographs, descriptions, dimensions, and condition information carefully before purchasing.

Our goal is to provide enough information for customers to make confident, informed decisions.

3. Authenticity, Age & Attribution

The identification and dating of antique furniture involve examination, historical knowledge, comparison, and professional judgment.

Unless supported by specific documentation, descriptions of an item's age, origin, period, style, or maker represent our good-faith assessment based on the information reasonably available to us.

Approximate dates, including descriptions such as "circa 1800," indicate an estimated period of manufacture rather than an independently verified manufacturing date.

Terms such as "attributed to," "in the manner of," and "style of" have distinct meanings and should not be interpreted as documented proof of manufacture by a particular cabinetmaker or workshop.

When meaningful documentation is available, such as an original maker's label, historical inventory record, or documented provenance, we endeavor to identify that evidence in the listing.

Provenance based on family tradition or other unverified information will be distinguished from documented history when known.

We welcome questions about attribution and are happy to explain the evidence supporting our descriptions.

Nothing in this section limits a customer's rights concerning materially inaccurate descriptions or representations.

4. Product Descriptions, Images & Measurements

We strive to present every item accurately through detailed descriptions, quality photography, and relevant measurements.

Because screen settings, lighting, and photographic conditions vary, minor differences in perceived color or finish may occur.

Measurements are provided in good faith and may be approximate, particularly for furniture with irregular or handmade construction.

Customers should confirm critical dimensions before purchasing, especially when a piece must fit a specific location or pass through narrow access points.

We may occasionally use digitally styled or editorial interior images to illustrate how furniture might appear in a room setting. Such images are provided for decorative inspiration and should not replace actual product photographs when evaluating condition, construction, color, or other physical characteristics.

We encourage customers to contact us for additional photographs, measurements, or condition information whenever needed.

5. Inventory Availability & Orders

Many of our items are one-of-a-kind and may be offered through multiple sales channels.

Although we make every effort to maintain accurate inventory information, an item may occasionally become unavailable before our website or marketplace listings are updated.

Submitting an order does not guarantee availability until the transaction has been confirmed.

If an item is unavailable, we will notify the customer and promptly refund any payment collected for that item.

We reserve the right to correct genuine pricing or listing errors. If a material error affects an order before fulfillment, we will contact the customer to explain the issue and offer an appropriate resolution, including cancellation and a refund where applicable.

We will not substitute a different item without the customer's agreement.

6. Prices, Payments & Taxes

Product prices are displayed in U.S. dollars unless otherwise indicated.

Shipping charges, sales taxes, and any separately agreed services may be additional to the listed purchase price.

Furniture delivery is generally quoted individually rather than automatically included in the product price.

Payments may be processed through our website, a secure payment invoice, or another mutually agreed payment method.

Customers are responsible for providing accurate billing, contact, and delivery information.

Any special payment arrangements, deposits, or agreed purchasing conditions will be communicated as part of the individual transaction.

7. Shipping & Delivery

Pearl City Antiques coordinates furniture transportation throughout the contiguous United States using experienced delivery partners.

Because antique furniture varies considerably in size, weight, fragility, and handling requirements, furniture shipping costs are generally determined through personalized quotations.

Customers may request a shipping quote through the product page or by contacting us directly.

Delivery costs, handling requirements, and anticipated timelines will be communicated before transportation arrangements are finalized.

Delivery estimates are based on available carrier information and may change due to scheduling, routing, weather, or other circumstances.

If we cannot ship an order within the stated or legally applicable shipment period, we will provide the delay notices, cancellation options, or refunds required by applicable law.

Please review our Shipping & Delivery Policy for additional information about quotes, transportation, local pickup, delivery access, and shipping concerns.

8. Returns, Refunds & Damaged Merchandise

Because our inventory consists primarily of antique and vintage items, many of which are unique and cannot be readily replaced, sales are generally final for ordinary changes of mind or buyer's remorse.

However, our final-sale policy does not eliminate rights or remedies available under applicable consumer-protection laws.

If an item arrives damaged during transportation, differs materially from its description, or presents another concern involving its condition or conformity with the sale, please contact us promptly.

We request notification within 48 hours of delivery whenever possible, allowing us to document the circumstances and coordinate with relevant transportation partners.

This requested reporting period does not waive or restrict rights available under applicable law.

We evaluate concerns individually and work toward an appropriate resolution, which may include repair, refund, or another remedy consistent with the circumstances and applicable legal requirements.

For additional information, please review our Refund Policy.

9. Customer-Arranged Transportation

Customers may arrange their own collection or transportation when agreed in advance.

Free pickup is available by appointment from our Westfield, Massachusetts warehouse.

Customers who select an independent carrier are responsible for communicating pickup arrangements and ensuring that the carrier is prepared to handle the item appropriately.

Responsibility for handling and transportation after release to a customer-selected carrier is addressed in our Shipping & Delivery Policy, subject to applicable law and any written arrangements agreed before collection.

10. Interior Designers & Trade Purchases

We welcome purchases from interior designers, decorators, collectors, and other trade professionals.

Trade inquiries, receiving warehouse arrangements, and special delivery requirements should be communicated before completing a transaction.

Any special pricing, reservation arrangements, or other transaction-specific conditions will be confirmed individually.

Unless otherwise agreed in writing, purchases remain subject to the applicable product descriptions and policies described in these Terms.

11. Website Use & Intellectual Property

The content appearing on pearlcityantiques.com, including original photographs, written descriptions, editorial content, graphics, and branding, is owned by Pearl City Antiques or used with appropriate permission, except where otherwise indicated.

This material may not be reproduced, republished, commercially distributed, or used to represent merchandise offered by another seller without permission, except as permitted by applicable law.

Visitors agree not to misuse the website, interfere with its operation, attempt unauthorized access, or use its services for unlawful purposes.

We reserve the right to restrict access where reasonably necessary to protect our business, customers, or website security.

12. Third-Party Services & Websites

Our website may contain links to third-party services, payment providers, transportation companies, or other external websites.

These services may operate under their own terms and privacy policies.

We are not responsible for the independent content or practices of unrelated third-party websites.

This provision does not remove responsibilities that Pearl City Antiques may have regarding purchases or services we have expressly agreed to provide.

13. Privacy & Customer Information

We respect the privacy of our customers and visitors.

Personal information collected through our website or purchasing process is handled in accordance with our Privacy Policy.

By providing contact, billing, or delivery information, customers authorize its use for legitimate transaction-related purposes, subject to applicable privacy laws and our published Privacy Policy.

14. Website Availability & Legal Rights

We make reasonable efforts to maintain accurate information and reliable website functionality, but occasional technical interruptions, maintenance, or service disruptions may occur.

To the extent permitted by applicable law, Pearl City Antiques is not responsible for losses arising solely from temporary website unavailability or interruptions beyond our reasonable control.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including responsibilities arising from applicable consumer protections, enforceable warranties, material misrepresentations, or other statutory obligations.

15. Governing Law & Resolution of Concerns

Pearl City Antiques operates from the Commonwealth of Massachusetts.

To the extent permitted by applicable law, these Terms are governed by Massachusetts law, without overriding consumer protections that may apply in another jurisdiction.

We encourage customers to contact us directly if a concern arises regarding a purchase or transaction.

Our preference is to address questions and disagreements through prompt, respectful communication whenever possible.

Nothing in these Terms prevents a customer from exercising rights or pursuing remedies provided by applicable law.

16. Changes to These Terms

We may revise these Terms of Service periodically to reflect changes in business operations, applicable laws, or website functionality.

Updated Terms will be posted on our website.

Changes will apply prospectively unless otherwise required by law or agreed with the customer. Transactions already completed will remain subject to the applicable terms in effect at the time of purchase and any specific written agreements made for that transaction.

17. Contact Information

We believe that trust and transparency are essential to every successful antique furniture purchase.

If you have questions about an item, these Terms, or any aspect of purchasing from Pearl City Antiques, we welcome the opportunity to assist.
